Terms of Service

1. Who we are

Abhilekh (“the Service”, “we”, “us”) is an AI-powered social media content platform operated by Abhijit Paranjape (“the Owner”), a sole proprietorship based in Pune, Maharashtra, India, doing business as Abhijit.

2. Acceptance of these terms

By creating an account, redeeming a trial code, or using the Service in any way, you agree to these Terms of Service, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a contract in India (or the equivalent in your jurisdiction). By using the Service you represent that you meet these criteria.

4. Your account

  • You are responsible for keeping your password confidential.
  • You must not share your account credentials with anyone else.
  • You are responsible for all activity on your account.
  • Notify us immediately at +91 99233 84420 if you suspect unauthorised access to your account.

5. Content you generate and publish

The Service uses AI models (Claude, OpenAI, Fal, Kie, ElevenLabs, and others) to generate text, images, and video from the briefs you provide.

You own the outputs. Once generated, the content is yours to use, edit, publish, resell, or delete. We claim no ownership of your generated posts, images, videos, or captions.

You are responsible for the content you publish. This includes ensuring the content:

  • Does not infringe anyone else’s copyright, trademark, or other IP
  • Is not defamatory, harassing, obscene, or otherwise unlawful
  • Complies with the terms of the destination platforms (Instagram, LinkedIn, Facebook, X, Threads, YouTube, Pinterest)
  • Complies with all applicable Indian and destination-country law

We publish content on your behalf via third-party publishers (currently Blotato). We are not the publisher of record on the destination platforms — you are.

6. Acceptable use

You must not use the Service to:

  • Generate or publish content that is illegal, defamatory, hateful, harassing, sexually explicit, or targets minors
  • Impersonate any person or entity, or misrepresent your affiliation
  • Generate content designed to defraud, deceive, or manipulate markets
  • Generate mass spam, click-farm content, or engagement-manipulation posts
  • Reverse-engineer, decompile, or attempt to extract our prompts, models, or system internals
  • Use the Service to build a competing content-generation product
  • Scrape, crawl, or overload the Service beyond normal use

Violations may result in immediate suspension without refund. Serious violations may be reported to law enforcement.

7. Third-party AI providers

The Service depends on third-party AI providers to generate content. These include Anthropic (Claude), OpenAI (gpt-image), Fal (Hailuo, Nano Banana, SadTalker), Kie.ai (SeedAnce-2), ElevenLabs (voice), and Blotato (publishing).

Each of these providers has its own terms of service and content policies. By using the Service, you agree that:

  • The AI models may produce outputs that are factually wrong, biased, or otherwise flawed. You are responsible for reviewing every output before publishing.
  • Providers may change their pricing, availability, or content policies without notice, and we may need to adjust the Service in response.
  • We are not liable for outages, degraded quality, or policy changes on the part of these providers.

8. Subscription plans and payment

The Service is offered on monthly subscription tiers (Lite, Starter, Pro, Reel Pack, Agency). Current pricing is on our /pricing page. Payment is collected off-application via WhatsApp coordination pending the launch of our billing platform.

Monthly quota resets on the 1st of every UTC month. Unused posts do not roll over. Your account continues at the same tier until you request a change or cancellation.

9. Cancellation

You can cancel your subscription at any time by messaging us on WhatsApp at +91 99233 84420. Cancellation takes effect at the end of your current billing month.

There are no cancellation fees. Refunds are governed by our Refund Policy.

10. Trial codes

Trial codes (e.g. ABHILEKH-XXXXXXXX) are issued at our discretion. Each trial code:

  • Has a fixed generation quota (usually 2–5 posts)
  • Expires on a fixed date (usually 30 days from issue)
  • Cannot be redeemed by anyone except the intended recipient
  • Cannot be used to publish content — only to generate previews
  • Is single-use and cannot be transferred, sold, or redeemed twice

11. Referral program

Every user gets a unique referral code. When a friend signs up using your code and activates a paid tier, you earn one free month of service credited to your account. Your friend gets 20% off their first paid month.

Self-referrals are not permitted. We reserve the right to withhold rewards for suspected abuse (e.g. fake accounts, click-farming).

12. Intellectual property

The Service’s code, brand, name (“Abhilekh”, the compass-star mark, the “Abhijit.” parent brand), copy, and design elements are owned by us. You may not use them for your own commercial purposes without written permission.

Your generated content is yours. See §5.

13. Data and privacy

Our handling of your data is described in the Privacy Policy. In short: we store your account details and generated jobs for the operation of the Service, and we do not sell your data.

14. Warranties and disclaimers

The Service is provided “as is” and “as available”. We make no warranties, express or implied, about the Service’s fitness for a particular purpose, uptime, accuracy of AI outputs, or continuity of third-party integrations.

15. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim relating to the Service is capped at the amount you paid us in the three months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including loss of business, loss of profits, or reputational harm arising from your use of the Service.

16. Changes to these terms

We may update these terms occasionally. Material changes will be notified by email to your registered address at least 15 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.

17. Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.
